By visiting or shopping at the online store of www.ellishbeachwear.com (hereinafter referred to as Ellish), you are bound by our purchase and use conditions. Therefore, it is important that you carefully read the general terms of use before using the website. By using and/or ordering through the website, you agree to these general terms and conditions of purchase and use. Ellish reserves the right to modify these terms and conditions. If the general conditions are changed after you have placed an order, the general conditions that were in force at the time of the order will apply.
If there are links to third parties on the Ellish website, or if third parties publish Ellish's material, Ellish cannot be held responsible for any damage or loss as a result of using the current information, as Ellish does not control the content of these websites.
All references in these terms and conditions to “Ellish,” “Ellish Beachwear,” or “the online store” are references to Ellish Beachwear / Sharon Grobben, Oude Brugstraat 27, BE 2491 Balen, business number 0788.187.653.

 

Article 1 - Processing of Personal Data

Your personal data is processed in accordance with the applicable legislation concerning data protection, including the General Data Protection Regulation (GDPR) (EU 2016/679).
We always do everything possible to ensure that your personal data is processed within the EU/EEA. However, if it happens that your personal data is processed outside the EU/EEA, we will ensure that an adequate level of protection is provided by taking so-called appropriate safeguards, such as the EU's standard contractual clauses.
Ellish shares information with other companies that process data on our behalf to perform our services, such as marketing, analytics, distribution, or other services, or if we are required to do so by public authorities under current legislation.

 

Article 2- Sales Agreement

The e-commerce website of Ellish Beachwear, offers its customers the opportunity to purchase products from its webshop under the following conditions.
When placing an order, a sales agreement is established between Ellish and the adult client. Every person who places an order on the site www.ellishbeachwear.com agrees with the sales, delivery, and payment conditions.
An item or size that is no longer available will not be available in the webshop in principle. However, errors in the stock program are possible. We ask for your understanding.
Orders on the webshop are updated on a regular basis. We do everything possible to confirm your order as soon as possible. If you place an order during the weekend or on a holiday, we will do everything possible to process your order on the next normal working day by 18.00 hours.
If an article is no longer available, you will be informed as soon as possible. In that case, your payment will be refunded within 15 working days, without costs.
Ellish reserves the right to cancel the order if the price is incorrect, an error is listed online, or an action is not properly complied with.

 

Article 3 – Prices

All listed prices are in EURO, including 21% VAT, but excluding shipping costs. All prices are per piece unless otherwise indicated. Shipping costs are clearly displayed separately. Ellish reserves the right to change the prices of the products and the product information and to correct them.

 

Article 4 – Offer and Photos

The offer of Ellish contains as accurate a description of the offered products as possible. The description is sufficiently detailed to enable a good assessment of the offer by our customers. The accompanying photos are truthfully displayed. Minor color differences with what you see on your screen and the actual color are possible, depending on the quality/calibration of your screen. Ellish cannot be held liable for obvious mistakes or errors in the offer.
If you as a customer have specific questions about, for example, sizes, color, availability, delivery time, or delivery method, we request you to contact our customer service via info@ellishbeachwear.com.

 

Article 5 - Online Purchases and Payment

All items can be purchased on our webshop by adding them to the shopping cart. You can choose to check out or continue shopping at any time. As long as it has not been checked out, the order can always be changed.
Through the payment system of Multisafepay, you can pay online. You are offered various payment options for this.
You follow the steps on the screen. After the payment, you will receive an email confirming the order and payment.
If you wish an invoice, you can tick this option and fill in the correct details of the company.
You must provide a delivery address and complete contact details. The fastest way to provide these details is by registering as a customer on our website or through our checkout procedure in the online store. Once you have completed the purchase, you will receive a message from us that your purchase is ready to be delivered.

 

Article 6 - Property Right

The items remain the exclusive property of Ellish until the moment of full payment by the customer.

 

Article 7- Delivery and Execution of the Agreement

Upon receiving your payment in our account, the package will be prepared with the utmost care for you. You can choose from various shipping options. The shipping costs will always be mentioned at checkout.
The normal delivery time is approximately 4 to 5 working days for deliveries in Belgium, 5 to 8 days for the rest of Europe. Oversea shipments can maybe take a bit longer.
If the ordered product is not in stock, you will be informed via email, and you can opt for a refund or wait until the article is back in stock.
Ellish reserves the right to adjust the shipping rates if necessary. For damages, mistakes, or other problems during shipping, we cannot be held liable. If the customer notices a visible damage or quality deficiency or other deficiency of an article, this must be communicated to Ellish immediately by the customer.

 

Article 8 - Revision of these Terms

We may revise these terms at any time by updating them on this webshop. We advise you to regularly read this page for any changes in the terms, as they are binding for you.

 

Article 9 - Jurisdiction and Applicable Law

Belgian law applies to all disputes related to or arising from our offers and/or agreements. In the event of disputes or contestation, only the courts of the judicial district of our registered office are competent.

 

Article 10 – Force Majeure

Ellish is not liable for delays due to circumstances over which Ellish has no control, such as general labor disputes, war, lightning strikes, terrorist attacks, changed decisions by authorities, technical problems, errors in electricity/telecommunications/computer connections or other forms of communication, and defects or delays in services of subcontractors as a result of the aforementioned circumstances. These circumstances constitute reasons to refrain from claims for damages and other penalties.
